This Is Interesting...

It would appear that what is decided as the amount of money that goes to probate depends on the bank and they set the threshold so in theory if they decided the amount was £2,000 or £50,000 they are to blame. They set the rate.

Today when I applied for the forms to do Probate myself the Gov department suggested that if when the funeral costs are removed from Mum's Estate depending on how low the capital is reduced some banks might waiver the probate and they felt that as the wills are straight forward(What is Mum's is mine and vice versa)they are a little surprised that Probate has happened. And its unfortunate.

They also suggested that there is no time limit as to when you have to sort out Probate(Its not urgent)so does that mean that I can stay as I am and leave Mum's savings sitting there indefinately and that way I still receive help and apply for Mum's savings some time in the future that suits me. Or in theory if I did that woeventually would the Government or the bank take Mum's money and it would be lost forever.

Good questions! I've no idea.
I wonder if you have a legal advice centre attached to your town hall. Some do.

You'll have apply for probate on your Mother's money sooner or later, otherwise it will all go to the Govt. If even if you didn't apply for probate, the relevant authorities would know that you stood to inherit your Mother's money, so I doubt very much whether they'd keep giving you your disability allowance . just because you'd chosen to delay inheriting your Mother's money.
If you didn't tell the the authorities that you've got that money to come to you, that would be fraud I'm afraid.

It does seem an unfair way of going about things......and I'm not very impressed at all. I don't know how you could even think about it.

Perhaps the CAB can answer this on May 8th...

My DLA has gone up to approx £100(as long as I am awarded it)I found that out today and that isn't means tested. So in theory Mum's savings will be spent for electric/gas/food and the community charge...still won't take long to see it reduce.

DLA has nothing to do with savings...if you were in my shoes perhaps you might...and its all new to me. Its being replaced next year, the alternative is 20% less and the criteria for entitlement is being raised so many genuine people will fall fall foul of the new rules so you'll get your way.

Take no notice, Gildy.
We all know that you're just trying to think of everything at once.
You've got an awful lot on your plate at the moment but it will all get sorted, eventually.

Thanks VQ...

I think that I am very open on here and honest. I mean I could delete negative comments but so far I have left them up for anyone to read.

Even if I am poor as a church mouse in the future as long as I can get by and I am not told that I will be put on the streets and become homeless, I will survive and it helps that many of you think I will survive.

Our gardener did the front garden as a favour to Mum today for free because he liked Mum and he wanted it tidy for the day of the funeral.

He liked Mum and Mum loved her garden. From now on(I can't do it)and if I attempted to a bit at a time even though I'd suffer later someone somewhere would say if I am fit enough to do that...well you can guess.

So I'll have to ask the council to tidy my garden in future(they'll just cut the lawns)and unlike him they won't pick up the grass. Oh well...

Unless I can eventually still afford him but maybe not have him call as often as he did. I think he charged Mum £5 an hour. Not sure about the window cleaner either, I may have to ask him to do the windows less often...They don't get very dirty...

Perhaps I can invest in one of those gadgets that I think are like a magnet and when you move the gadget on the inside of the window it does the window on the outside. I bet I'd get into trouble using that.

Unless I can persuade a neighbour to do my front garden for me its very tiny...but that still leaves the back garden...

I'm a bit surprised you don't know how much your Mum paid the window cleaner, I thought your poor Mother been almost bedridden for the last few months of her life .

If you're worrying about the garden getting out of hand, perhaps you'd cope better in a housing association flat.

OK, its the way I wrote my post, it costs about £5 for the windows.

And the garden can be included in the rent at no extra cost. I understand that is the case.

I'll look into it. I may still be able to have my gardener put flowers in the borders and do the tubs...as a tribute to Mum.

Then again I have bulbs that come out every year and they do that without any help from me.

I might have to prune shrubs once in a while. Not often. So its not a regular task. And you are not doing it for hours. So its not like work. Even sticking a couple of flowers in compost is a one off task. And once done that's it...

Mowing and digging takes more doing.

I cannot make any decisions about what I am able to do, where to live, finances until Mum's savings are sorted and I have talked to the CAB...

There is also big changes that do not guarentee that ill people will be looked after by the benefits system between now and 2013 so its not just the so called people who do not want to work that the Government and media keep going on about.

And I have to think of the funeral, tidying the house and possibly seeing Mum one last time in the Chapel Of Rest.

For now I realise I haven't eaten today so I away to have something, I won't enjoy it but if I don't I will be ill.

Chicken or fish I think...that's a hot meal or sandwiches in case the date on the sliced meat goes by...

And I am so cold and my neck is aching so I think I shall go to bed and listen to the radio.

It's awful the way you keep going on about my "Poor" Mother being bedridden...I lived through it and did all that I could. Do you want me to feel guilty for the rest of my life?

Who says you have anything to be guilty about? You've said that! I thought that Anon was trying to be helpful, and how many times has anyone said "Poor" about your Mother?

Calm down!

I am calm regardless of how I come across. And I am always ready to apologise. Its a bit difficult with so many Anon's leaving comments...

Even if a name is not left, a screen name would help.

How bitter you sound Anonymous!

Perhaps you should refrain from sucking lemons, you might feel a little less acid.

Anthony, don't buy that gadget to do the windows, well not if you have double glazing as they are totally useless. I have one!

I am worrying about money too - just can't seem to make ends meet these days and my bank account keeps going more and more overdrawn and I'm not used to it.

C :o)

Yes, I have Double Glazing. The house seemed fine with ordinary windows but they made us have them.

The house now doesn't seem any warmer through having it but maybe it would be colder without them. I know that we are all struggling these days(in work or out of work, retired, ill)I do wonder where its all going to end. I feel it for you too Carol.

I hope that you can manage to keep your head above water.

Sadly those who run the country do not understand. And they saythe money isn't there but it could be if they wanted it to be. And had different priorities.
