I was Given An Apology...

regarding the Co-Op contacting about Mum's estate, probate and legal matters an hour before Mum's funeral(that should not have happened)and he's going back to tell them at his office.

The solicitor from the Co-Op wants to take £1,999 and a few other costs out of Mum's meagre savings if they handle Mum's affairs and he says it will take 6-9 months to go through and until I come into Mum's savings I will continue as I am.

It takes that long because they wait to see if anyone comes out of the woodwork to make a claim on Mum's money.

If I do it I may save that fee but I will have court costs and the cost of travelling to a so called local office to say an oath that everything is as it is and probably somewhere else. I wouldn't have to do that myself.

So I am going to think about it for a few weeks...he said it is not urgent(But I think he'd have liked me to sign up today just the same...

Hasn't your Mum made a will naming you? I thought that was the objective of making a will, and if it's been drawn up properly and you are named as sole beneficiary it should be straight forward. The only ones crawling out of the woodwork as you so nicely put it could be anyone who think they are owed money......

What they have told you just doesn't ring true with me, Gildy.
As Anon says, your mum made a will, presumably naming you as beneficiary.
Providing the will was signed and witnessed, there shouldn't be a problem.
Just think what you could do with the £2000 the Co-op want to take off you.
Will you be going to the CAB again? They might advise you.

I am told that the Nat West would've released the money if it had been £15,000 or less...I will go and see the CAB again and try and get another appointment. I'm leaving things over the weekend and look at things afresh from Monday.

The will is straight forward even the guy from the Co-op admitted that.

And if you get this hassle/stress when it is you wonder why you bother making a will. I have so little I don't think I'll be bothering again. I'll leave it to the authorities...I won't be here after all...

Have you considered free legal advice on the internet? Try this and see what happens providing you are willing to fill in their form fully.

Something to consider alongside the Money Saving Expert website...

Thanks Nick!

I did my own probate when my father died in 1975. It was a trifle anxious time but providing your signature is put on the form in the presence of two other witnesses and using the same pen then everything goes off OK.

Can't remember, of course, how much it cost then but was considerably cheaper doing it myself.

It's take, take, take all the time. Mum only had a small nest egg. And they still want more...I should be thankful that there was some money to cover the funeral.

Just gave the Co-op guy's paper work a quick look over. Now remember this is an estimate so it could cost more...

They said over the phone approx £1,990 but his written quote with some extra costs added is £2,560 and with the funeral costs that's nearly £5,560.

Which may mean some help immediately for me because I've dropped under the threshold where you do not receive any help of any kind but again if it takes a while to sort out, I remain as I am and continue to have some financial help.

I don't understand how they can quote you that much. My Mum's estate was much more complicated , she left it to my brother & myself & she had savings in 4 different accounts, it took 8 months & the bill came to only just over £2,000.

They could be trying it on! Is it any wonder that people dislike the legal profession?
